Terms of Service
Lamp & Kin Version 1 (draft). Effective [DATE]. Last updated 24 October 2026.
Welcome to Lamp & Kin. These terms are the agreement between you and us when you use lampandkin.com and buy our books. We've tried to write them the way we'd explain things in person. Please read them, along with our Privacy Policy, Refund & Reprint Policy and AI and your photos, which form part of these terms.
Who we are: Lamp & Kin is a sole proprietorship owned by Sumeet Singh Mankoo, [BUSINESS MAILING ADDRESS], Burlington, Ontario, Canada. Email hello@lampandkin.com. Phone [PHONE NUMBER].
Your rights as a consumer come first. Nothing in these terms takes away rights you have under consumer protection law where you live, including Ontario's Consumer Protection Act, 2002. If a part of these terms conflicts with those rights, the law wins.
1. Who can use Lamp & Kin
- You must be 18 or older (or the age of majority where you live, if higher) and able to enter a contract.
- Lamp & Kin is for parents, guardians and family members making books for their own family. It isn't for children to use. Please don't let a child use your account.
- One person per account. You're responsible for what happens in your account, so keep your email account secure, because that's how you sign in.
- We may refuse or close an account that breaks these terms (section 6).
2. What we offer
- Free: you can create characters and a story and see the cover and two sample pages at no charge, within reasonable limits on the number of drawings and redraws per draft.
- Ebook + print-at-home booklet: CA$19.99. Unlocks the full book as digital files.
- Printed hardcover: CA$74.99, shipping included. Includes the digital files. [[US pricing: US$59.]]
Prices are shown before you pay, in the currency shown at checkout. We may change prices for future orders, but never for an order you've already placed.
3. Your content, and the licence you give us
"Your content" means the photos, names, details and story text you provide, and your edits and choices.
- You keep ownership of your content.
- You give us a limited licence to use your content only to make, show you, store, deliver and print your book, to provide support, and to keep the service safe (for example, our automated photo check). The licence is worldwide (because our providers work in other countries), non-exclusive and royalty-free. It lets our service providers do the same on our behalf, only for those purposes.
- The licence ends when you delete the content or your account, except for copies already sent to print or already delivered to you, and backups that roll off on the schedule in our Privacy Policy.
- We won't use your content or book in advertising, show it publicly, or use it to train AI models, without your separate written permission.
4. Your promises about the people in your photos
Each time you upload a photo, and each time you order, you promise that:
- You are the parent or legal guardian of every child in the photo, or you have the permission of that child's parent or guardian.
- Every adult in the photo has agreed to you using it to make a Lamp & Kin book (or you are that adult).
- You took the photo or have the right to use it, and using it here doesn't break anyone else's rights, such as copyright or privacy.
- Everything you tell us about the people in your book (names, ages, relationships) is accurate to the best of your knowledge.
- You'll stop using, and delete, someone's photo or character if they (or their parent or guardian) withdraw their permission.
These promises matter, because a book shows real people and we can't ask them ourselves. If you break them, you are responsible for the consequences, as section 13 explains.
5. What you may not do
You may not use Lamp & Kin to:
- upload photos of anyone else's children without their parent's or guardian's permission, or of any adult without their permission;
- make images of celebrities, politicians, influencers or other public figures, or of real people you don't know personally;
- upload or make images involving nudity, partial nudity or sexual content of any kind. For children this is absolute, and includes bath, beach and nappy photos. We will report child sexual abuse material to the authorities;
- make hateful, harassing, bullying, violent or degrading content, or content that mocks or targets a person or group;
- make deepfakes or deceptive images: anything meant to pass as a real photo, to impersonate someone, to mislead people about what a real person did or said, or to be used for fraud or harassment;
- put a real person in a story that embarrasses, sexualises, endangers or humiliates them;
- infringe others' rights, for example by uploading copyrighted characters, artwork or photos you don't have rights to;
- break the law, or encourage harm, self-harm or dangerous activity;
- resell, mass-produce, or use books commercially (section 9), or get around our usage limits, such as by opening several accounts;
- scrape, reverse-engineer, overload or interfere with the service, or try to get around our safety checks.
6. How we keep the service safe
- An automated check looks at every photo before anything is drawn and turns away photos that show nudity, a public figure or a cartoon character, or that are too unclear to draw. If you think a photo was turned away by mistake, email hello@lampandkin.com and a person will look at it.
- We may remove content, stop a book from printing, or suspend or close an account if we reasonably believe these terms have been broken, or if someone credibly tells us their image is being used without permission. Where it's safe and lawful, we'll tell you why and give you a chance to respond.
- If we close your account for a serious breach (for example, misuse of a child's image), we won't refund books already made, except as the law requires.
- To report misuse, email hello@lampandkin.com with "Report" in the subject line.
7. AI-made content: what to expect
Lamp & Kin uses artificial intelligence to draw illustrations and to help write the story. Please know:
- Likeness will vary. The illustrations are painted interpretations, not photographs. Faces, skin and hair colour, features, clothing and proportions may differ from the photos, and from page to page. We work hard on likeness, but we can't promise an exact one.
- AI can make mistakes: an extra finger, a strange object, text that doesn't quite fit. That's why you see and approve everything before you buy: you can edit any line, redraw characters and repaint pages, within the limits for each draft.
- You are the editor. Please read the whole book before ordering. Once you've approved and paid, what you saw is what we deliver or print. Our Refund & Reprint Policy covers defects; it doesn't cover changes of mind about content you approved.
- Story suggestions are just suggestions. You decide what your book says, and you're responsible for the final text.
- Every book carries an "Illustrated with the help of AI" line on its colophon page, and the files may contain invisible markers that identify them as AI-generated. Please don't remove them.
8. Who owns what
- Your story text: the words you write and the edits you make are yours. Text our system suggests and you keep becomes part of your story, and we claim no rights in it.
- Illustrations: to whatever extent we or our providers hold rights in the illustrations made for your book, we give you a perpetual, worldwide, royalty-free licence to use them for personal, non-commercial purposes. The law on who owns AI-generated images is still unsettled, which is why we put this as a licence rather than a promise of ownership. You may:
- keep, read, print and reprint your book for yourself, your family and friends;
- give printed or digital copies as gifts;
- share pages, covers or characters on your personal social media and in messages, as long as you don't sell them or use them to advertise anything. A credit to @lampandkin is appreciated, not required.
- You may not: sell your book or its illustrations, or products made from them (prints, mugs, clothing); use them in advertising or for a business; register them as trademarks; or use them to train AI models.
- Ours: the Lamp & Kin name, logo, site, software, page designs, typography, layouts, art style guides and story templates belong to us. Our story templates and art style may also appear in other families' books.
- Third-party AI terms: our AI providers' usage policies also apply to the content they help make. The prohibited uses in section 5 cover those policies.
9. Orders, pricing and taxes
- Checkout is run by Shopify. When you pay, you're buying from Lamp & Kin; Shopify processes the payment. We never see your full card details.
- Taxes (GST/HST/QST in Canada, and sales tax where it applies in the US) are calculated and shown at checkout before you pay.
- Your order is confirmed when payment is accepted and we email you a confirmation with the order details, which is your copy of the agreement. Keep it.
- Before you pay, you'll have a chance to review your order, correct mistakes, and accept or decline.
- We may cancel an order (with a full refund) if there's a pricing error, a suspected fraud, or a breach of section 5.
- Discount codes can't be exchanged for cash and may have their own conditions, which we'll show you.
- Where we ship: Canada and the United States, with standard shipping included in the hardcover price. Copies for the US are printed in the US, so there are no duties or brokerage fees to pay on delivery.
- Quebec: we don't sell to or ship to Quebec yet, while we prepare French versions of these terms and our checkout. Checkout won't accept a Quebec shipping address.
10. Digital delivery
- Once payment is confirmed, the full ebook and print-at-home booklet are unlocked in your account straight away, and we email you a link.
- Please download and keep a copy. We'll keep your book available in your account for as long as you keep it there, but if you delete your account, or the book, it's gone.
- Print-at-home booklets are designed for standard home printers and paper (Letter and A4). Results depend on your printer.
- If something doesn't arrive or won't open, tell us (see our Refund & Reprint Policy).
11. Printing and shipping
- Hardcovers are printed and shipped by our print partner, Lulu Press, Inc., and its network of printers and carriers. We send them your book's print files and the shipping details you give us.
- Before printing starts, you can change the shipping address or cancel for free. A hardcover goes to the printer 24 hours after you pay; until then you can cancel it on your order page for a full refund. Once printing starts, we can't change the book or cancel it.
- We'll show estimated production and delivery times at checkout. They're estimates, not guarantees, but if your hardcover doesn't arrive within 30 days of the estimated delivery date, you may cancel for a full refund (see our Refund & Reprint Policy).
- Please double-check the shipping address. If a parcel comes back because of an incorrect or incomplete address, we'll reship it for the cost of shipping.
- Ownership of, and risk in, the printed book pass to you on delivery.
12. Our responsibilities, and their limits
- We provide Lamp & Kin with reasonable care and skill, and the printed book will be free of manufacturing defects.
- Apart from that, and except where the law doesn't allow us to exclude it, the service is provided "as is", and we don't promise it will be uninterrupted or error-free, or that the illustrations will look exactly like anyone.
- To the extent the law allows, our total liability to you for any claim about the service or an order is limited to the amount you paid for the order the claim relates to (or CA$100 if the claim isn't about an order), and we aren't liable for indirect or consequential losses, such as lost profits or emotional distress from AI-made content you approved.
- None of this limits liability that can't legally be limited, such as for our negligence causing death or injury, fraud, or your rights under consumer protection law.
13. If you break these terms
If someone brings a claim against us because you uploaded a photo without permission, or otherwise broke section 4 or 5, you agree to cover our reasonable costs and losses from that claim, as far as the law allows. We'll tell you promptly about any such claim and let you help respond to it.
14. Ending things
- You can stop using Lamp & Kin and delete your account at any time with Delete my account and everything.
- We may suspend or close accounts under section 6, or stop offering the service. If we stop offering it, we'll give you at least 60 days' notice to download your books, and we'll refund or fulfil any orders already paid for.
- Sections 3 (as to copies already printed or delivered), 8, 12, 13 and 16 continue after your account ends.
15. Changes to these terms
We may update these terms as the service or the law changes. For meaningful changes, we'll email you and post a notice in the app at least 30 days before they take effect. Changes don't apply to orders you've already placed. If you don't agree with a change, you can stop using the service and delete your account before it takes effect. If you keep using the service after that date, the new terms apply.
16. Law, disputes and everything else
- These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
- Talk to us first. Most problems can be sorted out by email at hello@lampandkin.com, and we'll reply within 5 business days.
- If we can't resolve it, disputes go to the courts of Ontario. If you're a consumer living elsewhere, you can also use the courts, and rely on the consumer protection law, of the place where you live. We don't require arbitration, and we don't ask you to give up class actions.
- If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we haven't given up the right to do so later.
- These terms, together with the policies linked above, are the whole agreement between us about the service.
- These terms are in English. We don't serve Quebec yet; French versions will come first.
